In Appeal No. 40067/98, the appeal was dismissed with costs. In Appeal No. 40070/98, the appeal was allowed, the judgment of Young J was set aside, the liquidator’s notice of motion was dismissed with costs, and the respondent was ordered to pay the appellants’ costs of the appeal.
