CaseChat Overview and Summary
In Barnes v Director of Professional Services Review, the Federal Court was tasked with reviewing a decision by the Director of Professional Services Review under the Health Insurance Act 1973 (Cth). The applicant, a general practitioner, sought to challenge the Director's decision to establish a Professional Services Review Committee to investigate whether he had engaged in inappropriate practice. The legal issues before the court included whether the Director denied the applicant procedural fairness or natural justice in deciding what action to take under section 89C of the Act and whether the Director’s decisions were legally unreasonable.
The court found that the Director's decision-making process did not violate principles of procedural fairness or natural justice. The Director was entitled to consider the available options under sections 91, 92, and 93 of the Act, which included taking no further action, entering into an agreement under section 92, or making a referral to a committee under section 93. The court held that the Director's discretion under section 89C(2) was not subject to any specific preconditions and that the Director was not required to first explore the option of a section 92 agreement before referring the matter to a committee. The court emphasised that the concept of legal unreasonableness in administrative law involves the lawful exercise of power and does not permit the court to substitute its view for that of the decision maker.
As a result, the court dismissed the application for review and ordered the applicant to pay the costs of the proceeding.
