Ascic v Comcare

The court concluded that the notice of appeal did not connect to any aspect of the primary judgment, and thus, the appeal effectively sought to invoke a jurisdiction the Court did not have. Consequently, the court refused leave to amend the notice of appeal and dismissed the appeal, ordering Mr Ascic to pay Comcare’s costs of the appeal.
