The appeal foreshadowed by this application for special leave to appeal would be concerned, to a large extent, with issues of practice and procedure. Apart from these issues, the appeal would turn upon issues as to the application of settled legal principle to the facts of the case rather than upon issues of principle that require the attention of this Court. Having regard to these difficulties, the application should be refused.
Pursuant to r 41.08.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the application.
