1. This application for special leave to appeal from a decision of the Court of Appeal of the Supreme Court of Queensland (Flanagan JA, Bond JA and Bradley J agreeing) requires an extension of time. An appeal would not enjoy sufficient prospects of success to warrant the grant of special leave to appeal. Accordingly, it would be futile to grant an extension of time.
