REASONS
This judgment responds to an application to review a Registrar’s decision to decline to waive security for costs.
I agree with the Registrar that the appellants have not shown they cannot afford to pay security from all sources available to them, including assets in China, where they live. There is no public interest or other reason to justify depriving the respondent of security for costs.
The application for review is declined. Security must be paid by 27 October 2023.
