SC 84/2008
[2009] NZSC 6

BETWEENWILLIAM PATRICK JEFFRIES

Appellant

ANDTHE ATTORNEY-GENERAL

Respondent

Court:Elias  CJ, Blanchard and Tipping JJ

Counsel:D H O'Leary for Appellant

H S Hancock for Respondent

Judgment:4 February 2009

JUDGMENT OF THE COURT

ALeave to appeal is granted.

B           The approved ground is whether the Court of Appeal’s order of 20 October 2008, requiring the appellant to pay the respondent costs of $750.00, was properly made.

CIn granting leave the Court was satisfied that the case raises a point of general importance despite the very small amount at stake in financial terms.  The parties may, however, wish to reflect on whether the matter in issue is capable of resolution without the cost of a full hearing.
