JUDGMENT OF THE COURT

The application for an extension of time in which to file the case on appeal is granted.

REASONS OF THE COURT

(Given by Glazebrook J)

  1. The first appellant has filed an appeal against a judgment of the High Court delivered on 6 December 2010.[1]  The first appellant has applied for an extension of time in which to file the case on appeal under r 43 of the Court of Appeal (Civil) Rules 2005.

  2. The first and second respondents do not oppose the application.

  3. Accordingly, we grant the application for an extension of time.  The first appellant is required to file and serve the case on appeal by 12 October 2011.
