WAAKA-TIMOTI v LOCKWOOD [2013] NZHC 2673 [14 October 2013]

[1] On 16 September 2013 I adjourned the plaintiff’s application until today. I issued a minute which recorded the non-compliance with the High Court Rules in relation to the statement of claim and as to its service.

[2] The plaintiff has not amended his statement of claim.  He has not complied with the High Court Rules as to service.

[3] The plaintiff has filed a copy of a document  which  is  scandalous  and irrelevant and evidences an abuse of this court and its procedures. Accordingly, I strike the proceeding out.

[4] Because of the abusive and scandalous and irrelevant contents of  the plaintiff’s documents, I order that if the plaintiff wishes to file papers in the civil jurisdiction of the High Court, the Registrar shall refer the documents to a Judge or an Associate Judge before formally accepting the documents.

[5]      That is the judgment of the court.
