[1]      I have read the material and having heard from Ms Nicholson, I am satisfied that the extinguishment of the covenant should be made.  I will issue a full reasons judgment later.

[2]      I direct that the order that the land covenant described in Transfer B918535.1, registered  against  Lot  2,  Deposited  Plan  122011,  North  Auckland  Registry, Computer Freehold Register NA71A/354 (servient land) be extinguished in its entirety.
