JUDGMENT OF THE COURT

APPLICATION FOR LEAVE TO APPEAL IS DISMISSED.

REASONS

[1]       The applicant has been committed to prison for contempt.  He seeks leave to appeal against the Court of Appeal's refusal to grant a stay of the High Court's committal order pending the hearing by the Court of Appeal of his appeal against that order, which we are told has a fixture for 29 October 2008.  Assuming, without deciding, that this Court has power under the Supreme Court Act 2003 to determine such a question, we are dismissing the present application.  We are satisfied that the Court of Appeal has properly exercised its discretion in the matter in the particular circumstances, for the reasons it has given.
