JUDGMENT OF RONALD YOUNG J (Application for leave to appeal)

[1]      In these proceedings I allowed an appeal against a decision of the District Court and concluded that advertising for the Asia Pacific Poker Tour on two television channels, TV3 and C4 was publicising or promoting gambling.  TV Works now wishes to appeal to the Court of Appeal.

[2]      I am satisfied that leave should be given.  There is an identifiable question of law.  I accept that the issues raised are important to broadcasters and advertisers and

do have an element of public interest.
