The Court has considered the memoranda provided by the parties on costs in response to the invitation which the Court gave in its judgment on the substance of the appeal. The appellant is to pay $3,000 costs to the respondent and disbursements including the reasonable costs of travel and accommodation for one counsel to be fixed by the Registrar if the parties cannot agree.
