CaseChat Overview and Summary
The central legal issues before the court were whether the application for leave to appeal the Associate Judge's decision to decline leave to defend the application, except to present submissions, should be granted and whether a stay pending appeal should be imposed. Additionally, the court needed to decide on leave to amend the application for a stay to extend pending appeals of decisions: firstly, the Associate Judge's decision to strike out parts of the statement of defence and counterclaim, and secondly, an appeal against Mr DeMarco's conviction following a jury trial in 2019.
The court found that the application for leave to appeal the decision of the Associate Judge declining leave to defend the application, except to present submissions, was dismissed. The associated stay application was also dismissed. The court declined leave to amend the application for a stay to extend pending appeals of decisions: firstly, of the Associate Judge to strike out parts of the statement of defence and counterclaim and secondly, an appeal against Mr DeMarco’s conviction following a jury trial in 2019. Counsel had indicated that costs had been categorised on a 2B basis, and they were reserved in the circumstances.
The court's final orders were that the second defendant's application for leave to appeal the decision of the Associate Judge declining leave to defend the application, except to present submissions, was dismissed. The associated stay application was also dismissed. Leave to amend the application for a stay to extend pending appeals of decisions: firstly, of the Associate Judge to strike out parts of the statement of defence and counterclaim and secondly, an appeal against Mr DeMarco’s conviction following a jury trial in 2019 was declined. Costs were reserved in the circumstances.
