JUDGMENT OF THE COURT DELIVERED BY RICHARDSON P

  1. Peter Paul Barker is charged with very serious and substantial drug dealing.   Having heard full submissions from Mr Gibson on the application of various aspects of the considerations as to bail set out in R v Blaikie (1999) 17 CRNZ 122, we are not satisfied that the Judge exercised his discretion wrongly in refusing bail in this case.   It will always be open, of course, if there are unacceptable delays in bringing this matter to an expedtious hearing, for a further application to be made.

  2. The appeal is dismissed.
