JUDGMENT OF THE COURT

A        THE APPEAL IS DISMISSED.

BThe appellant is to report to the probation office at the Waitakere District Court at Henderson before 5pm on Friday 13 November 2009 to arrange a continuation of his sentence of community service.

REASONS OF THE COURT

(Given by Robertson J)

[1]       When this matter was called, Mr Heaslip advised that he had instructions to abandon the appeal.  This was confirmed by Mr McGrath who was present in Court.

[2]       The appeal is accordingly dismissed.

[3]       Mr McGrath must report to the probation office at the Waitakere District Court in Henderson before 5pm on Friday 13 November for arrangements to be made for the continuation of the sentence of community work.

[4]       The period of disqualification from driving remains in force.
