JUDGMENT OF THE COURT

THE APPEAL AGAINST CONVICTION IS DISMISSED.

REASONS OF THE COURT

(Given by Robertson J)

[1]       Having considered the written material and the additional evidence together with submissions from counsel, the Court is persuaded that the appeal against conviction cannot succeed and is accordingly dismissed.

[2]       The reasons will be issued at a later date.

[3]       Mr Martin’s bail is extended until 9am on Friday 28 July 2006 when he must surrender himself to the Registrar at the High Court in Auckland.
