JUDGMENT OF THE COURT

1. Mr Fairbrother has appeared and, on the instructions of his client, withdraws this appeal against a pre-trial ruling in the District Court holding that evidence in relation to the appellant’s blood alcohol level may be admitted in evidence at his trail.

2. The appeal is accordingly dismissed.
