| JUDGMENT OF THE COURT |
Mr Fairbrother has appeared and, on the instructions of his client, withdraws this appeal against a pre-trial ruling in the District Court holding that evidence in relation to the appellant’s blood alcohol level may be admitted in evidence at his trail.
The appeal is accordingly dismissed.
