S V THE POLICE HC HAM CRI 2008-092-4249 24 April 2008
[1] Mr S applies for bail. He faces charges of having possession for supply of methamphetamine, cannabis, LSD, and ecstasy, as well as a charge of driving while his licence was suspended. He has appeared in the Manukau District Court on those charges, but is currently in custody.
[2] Because he has a conviction for a relevant drug offence, any application for bail must be made to this Court, pursuant to s 16 of the Bail Act.
[3] Ms Beveridge advises that bail is not opposed, provided that certain conditions are imposed. Mr Robb indicates that those conditions are acceptable to Mr S .
[4] Accordingly, Mr S will be released on bail on the following conditions:
a) He is to reside at 223B Tui Road, Whangamata;
b)He is to observe a curfew at that address between 9 pm and 7 am each night and during those hours must present himself at the door of that dwelling upon request by any police officer.
c) He is not to apply for any travel documents.
d) He is to report to the Whangamata police station each Monday and
Friday between the hours of 8 am and 4 pm.
