JUDGMENT OF ASSOCIATE JUDGE LESTER


ROYAL v ZHENG [2025] NZHC 1395 [30 May 2025]

[1]    The plaintiff seeks summary judgment to enforce a judgment he obtained against Mr Zheng by the Xinxiang Intermediate People’s Court, Henan, People’s Republic of China. Proof of service has been provided and no opposition to the application has been filed.

[2]    Judgment is sought for the New Zealand dollar equivalent of the value of   the Chinese judgment which is given in Renminbi (RMB).

[3]    The value of the New Zealand judgment sought is NZD$7,539,224.80 based on the exchange rate as at 26 May 2025. Interest runs on the value of the judgment obtained in China and the judgment sought in New Zealand dollars includes interest.

[4]    Having regard to Ms Anderson’s written submissions dated 2 May 2025 and for the reasons set out in her written memorandum, summary judgment is entered against Mr Zheng in the sum of NZD$7,539.224.80 together with costs on a 2B basis of NZD$15,774 which includes disbursements.

[5]    In addition, the Registrar is to issue a charging order in terms of the draft charging order filed on 26 May 2025 upon the appropriate fee (if any) being tendered to the Registrar.
