REYNOLDS v EURO HOLDINGS LIMITED [2024] NZHC 800 [12 April 2024]

[1]                 The Liquidator seeks against Euro Holdings Limited an order that the transaction specified in the Liquidator’s application dated 10 November 2023 be set aside.

[2]That application showed a call date of 12 April 2024 at 11:45am.

[3]                 The respondent creditor did  not  appear  when  the  matter  was  called  on  12 April 2024 and Ms Hooker, counsel for the Liquidator, sought judgment in terms of the application.

[4]                 For the reasons set out in the application and supporting evidence, there is judgment for the Liquidator in terms of paragraphs (a),(b) and (c) of the application dated 10 November 2023 . Interest is to run from 20 April 2023.  Costs are fixed on  a 2B basis with disbursements as fixed by the Registrar.

[5]                 This order is not to be sealed and is to lie in court until an affidavit of service establishing that the application dated 10 November 2023 was served on the respondent creditor is filed.
