JUDGMENT OF FOGARTY J

[1]      This  is  a  notice  of  appeal  which  is  not  being  pursued  today.    Rather, Ms Sewell has advised me that the appellant is going to endeavour to have his guilty plea withdrawn.  That application will be made in the district Court.  Counsel agree the appeal should be left in place, pending the next procedural steps, because at present the home detention sentence is stayed.
