(Given by Hammond J)

[1]      We are delivering a results judgment now because the trial of this case is not all that far away, and counsel need to know where they stand.

[2]      We have heard counsel this morning.  We are most grateful to Mr Johnson, who has said everything that could have been said on behalf of his client.

[3]      Nevertheless,  in  the  result,  we  take  the  view  that  the  appeal  should  be dismissed, and it is.

[4]      We will give our reasons for this judgment as soon as we are conveniently able to do so.
