JUDGMENT (NO. 2) OF HEATH J

R v SULLIVAN and ORS [2013] NZHC 1978 [7 August 2013]

[1]      Earlier today, I heard applications by the Crown for orders that the charges against each accused be tried before a Judge sitting alone, rather than a jury,1  and, whether tried before a jury or not, changing the venue for the trial from Timaru to Christchurch.2      Both  applications  were opposed  by Mr Sullivan and  Mr White. Other accused did not seek to be heard on the applications.

[2]      For reasons to be given in writing later:

(a)       The  Crown’s  application  for  trial  before  a  Judge  sitting  alone  is granted.

(b)      The  Crown’s  application  for  change  of  venue  from  Timaru  to

Christchurch is dismissed.

[3]      The trial will begin in Timaru on 12 March 2014, as previously directed.
