When this appeal was called on Wednesday 15 March, Mr Barnsdale for the respondent handed up a letter establishing that the respondent was terminally ill.
Counsel for the appellant, Mr Carruthers, advised the Court that he was instructed in the circumstances to abandon the appeal.
The appeal is formally dismissed for these reasons.
