R V R HC AK CRI 2005-004-001002  30 May 2008

[1]      This morning, I heard the Crown’s application for rulings on the admissibility of hearsay evidence from six witnesses.

[2]      Admission of hearsay evidence from Ms Barnes, Mr Noble and Mr Long was not opposed.  I am satisfied that evidence is admissible.  It is ruled admissible.

[3]      I rule that the evidence of Ms Ramakrishnan, Mr Warrier and Ms Sajan is admissible, subject to the terms of any reliability direction the trial Judge may decide to give under s 122 of the Evidence Act 2006.

[4]      Reasons in writing will follow next week.
