JUDGMENT OF CHURCHMAN J

[re media applications]


[1]                 On 25 August 2017 I made an order granting an entitlement to media cover in this matter in relation to an application on behalf of NewsHub.1

[2]                 The    application    was    granted   on    the   standard   conditions    with   two modifications:

(a)that Ms Mouat may only be filmed or photographed in the dock when she first enters the courtroom and for no more than two minutes; and

(b)that no media coverage was to identify or refer to the daughter of the defendant and the deceased.

[3]                 Two further media applications have been received in relation to the sentencing, which is due to take place in the High Court at New Plymouth on         13 October 2017.

[4]                 One is from Stuff/Fairfax New Zealand. The other is from Radio New Zealand. Both applications seek permission to take photographs and the Radio New Zealand application also seeks permission to record sound.

[5]                 Counsel for the parties have been consulted. Counsel for the Crown consents to the applications subject to the conditions set out in my judgment of 25 August 2017 (referred to above). Counsel for the defendant confirms that the application is not opposed, again, subject to the original two conditions.

[6]                 I grant both the applications on standard conditions, subject to the two further conditions set out above, limiting photography of the defendant during the period of two minutes from when she first enters the courtroom and non-identification of the defendant’s daughter.
