RULING 1 OF NATION J

[1]      Before re-examination, Mr Hawes brought to my attention his intention to re- examine Miss Clark on statements that she made to the Police, firstly, about whether or not she saw blood at the scene where the incident occurred and a further matter relating to whether or not she made an allegation as to Mr Crozier’s involvement in response to it being suggested by the Police that it could have been her that struck Mr Thompson in some way.

[2]      I discussed the issue with counsel.   The Crown wish to refer to the earlier statements to deal with suggestions either of fabrication or questions as to her reliability in relation to the evidence she is giving.   Mr Zintl has accepted that it would be appropriate for the Crown to re-examine provided that the full parts of the

statements relevant to those two particular issues are put to the witness.

[3]      I will permit the Crown to re-examine in the way they intend to in relation to those two matters.
