v

B

Date:              18 October 2007

SENTENCE OF WILD J

[1]      My sentencing remarks of 4 July and my minute of 5 October both refer.  In those I indicated that I would discharge you without conviction, once satisfied that you had resigned your Directorship of Automotive Scrap Metals New Zealand Limited and that the Licensing Authority had cancelled the Second Hand Dealers Licence you held.

[2]      In my 5 October minute I indicated that I was satisfied that you had resigned your Directorship, but that I was not satisfied that your licence had been cancelled.

[3]      I am now satisfied that your licence has been cancelled.  The Registrar has referred to me copies of his 5/12 October exchange of letters with the Licensing Authority of Second Hand Dealers and Pawnbrokers.   As I am satisfied that you have returned Certificate No. 723076  to  the  Authority,  and  that  that  Certificate expired  from  12  October  2007,  pursuant  to  s30(6)  Second  Hand  Dealers  and

Pawnbrokers Act 2004, I now discharge you without conviction.
