MINUTE OF SIMON FRANCE J (application to vary suppression)

[1]      The Crown seeks a variation to suppression orders made on 31 May 2007. Mr B   opposes.

[2] The context is a Ministerial Inquiry being conducted by K McDonald QC in relation to the events which are described in my sentencing remarks, para [3].

[3]      I have heard from Mr Sandston in opposition, but conclude that the overall interests of justice support facilitating an accurate inquiry to the extent that can be

done consistent with the rationale for suppression.
