ORAL JUDGMENT OF HON. JUSTICE JOHN HANSEN

[1]      This matter was set down today to hear a s347 application by the accused, B  , relating to a number of counts.

[2]      The Crown have just indicated that it is accepted that there is no evidence that can be proffered in support of count 2, which is a charge of supplying class A controlled drug, namely LSD.

[3]      Accordingly, Mr B   is discharged pursuant to s347 of the Crimes Act

1961 on that second count.

[4]      As to the balance, all matters relate to class B and C drugs which are within the jurisdiction of the District Court and not this Court.    Accordingly, those other counts remaining are transferred to the District Court.

[5]      I note the indications are that discussions are already taking place between counsel, and it is likely that most outstanding matters will be resolved, and it may well be trial time will not be required.
