[1] The Public Trust, as executor of the will of Kathleen Flowers, is seeking probate in solemn form. One of the parties with an interest in this proceeding is MrsFlowers’ son, Alexander Chapman, who is aged 16. The Public Trust has applied to appoint a litigation guardian for Alexander. Not only does Alexander clearly have an interest in this proceeding, but is unable to be represented by other family members; his aunt and father both have conflicts of interest.
[2] Having considered counsel’s memorandum, the affidavit of Alexander’s natural father and Mr Revell’s consent to act, I make the following orders:
a) Philip George Revell be appointed as litigation guardian for
Alexander; and
b)The reasonable costs of Philip George Revell are met from the estate of Kathleen Regina Kim Flowers.
