JUDGMENT OF FOGARTY J

This man has been arrested on a breach of bail on the grounds of failing to answer the door.  He is on an electronic bracelet because he is under a community detention. Mr Allan described it as an alleged breach of bail.  I do not think it is necessary to decide whether it was a breach of bail.  Certainly, I have no facts to know whether it was a deliberate decision not to answer the door or simply he did not wake up to the knocking.  In any event the matter has been considered for District Court purposes by a very experienced Judge, Judge Noble, who has renewed the bail and I propose to follow the decision of Judge Noble and renew the bail on the same conditions.
