ORAL JUDGMENT OF DUNNINGHAM J

[1]      This  is  an  application  under  part  3  of  the  Charitable  Trusts  Act  1957 (the Act),  for  the  approval  of  a  scheme  to  vary  the  deed  of  settlement  of  the Parininihi Ki Waitotara Trust, dated 22 June 1983.

[2]      The   scheme   has   been   advertised   as   set   out   in   the   affidavit   of Dion Joseph Tuuta, dated 2 May 2016, and no opposition to the application has been filed.  The Attorney-General has also provided a report pursuant to ss 35 and 36 of the Act, where he sets out his conclusions that the proposed scheme is a proper one

and satisfies the requirements for approval in s 56(1)(a) of the Act.

[3]     The memorandum of counsel filed also explains the benefits to the administration of the Trust that the proposed amendments will effect.

[4]      Accordingly,  I  make  an  order  varying  the  deed  of  settlement  of  the Parininihi Ki Waitotara Trust, in accordance with the draft order presented with the application today.
