We have been asked to deal with this appeal urgently on the papers.
Essentially for the reasons given by Morris J in his judgment of 1 December, and recognising that it involves the exercise of discretion on his part, we are not persuaded that the Judge erred in refusing to grant an interim injunction.
The appeal is dismissed with costs in favour of the respondent of $2,000 together with any reasonable disbursements as fixed, if necessary, by the Registrar.
