JUDGMENT OF THE COURT

The application for leave to appeal is dismissed.

REASONS

  1. The Court of Appeal dismissed an appeal which Mr Morell had brought to it against a decision of the District Court under the now repealed Proceeds of Crime Act 1991. The Court did so on the dual grounds that it had no jurisdiction and Mr Morell had no standing to appeal in any event. We consider that the decision of the Court of Appeal in these two respects was undoubtedly correct for the reasons the Court gave.

  1. The applicant’s proposed appeal to this Court has no prospects of success and it would not be in the interests of justice to grant leave.  For these reasons leave must be declined.
