JUDGMENT OF THE COURT

A        The application for leave to appeal is granted.

B        THE APPROVED GROUNDS OF APPEAL ARE:

(i)Whether, consistently with the New Zealand Bill of Rights Act 1990, s 29 of the Racing Act 2003 authorised Thoroughbred Racing to make Rules of Racing relating to random drug testing of riders.

(ii)Whether Ms Cropp consented to provide her urine sample on 7 May 2005.

(iii)Whether by reason of the Rules and the Drug Testing Protocol For Riders Ms Cropp was lawfully required to provide that sample.
