JUDGMENT OF CHURCHMAN J

[Security for costs]


[1]        In a judgment dated 19 September 2024 I directed that the costs in this proceeding lie where they fell.

[2]        The appellant had paid into Court the sum of $2,000 by way of Security for Costs in accordance with my minute of 9 August 2023. That sum has not yet been refunded to the appellant.

[3]        Accordingly, as costs lie where they fell the appellant is entitled to a refund of the $2,000 and I direct that the $2,000 (together with accumulated interest, if any) be refunded to the appellant.
