AS TO FURTHER DIRECTIONS AND COSTS

[1]      There  will  be  timetabled  orders  in  terms  of  paragraph  2  of  the  joint memorandum of 14 February 2011.

[2]      The  matter  is  adjourned  to  1  May  2011  by  which  time  any  further interlocutory applications are to be filed and the parties are to have decided whether they intend to pursue mediation or an alternative dispute resolution procedure.  By that time a joint memorandum is to be filed indicating further steps that need to be taken and the issues that need to be resolved.

[3]      I have considered the memoranda of counsel relating to costs.  Costs will be reserved and determined at the conclusion of the case.
