JUDGMENT OF THE COURT ON COSTS

The applicant must pay the respondent costs of $2500 together with reasonable disbursements.

REASONS

In its judgment dismissing the application for leave to appeal, the Court reserved costs.  The Judges who determined that application have now considered the written submissions of the parties concerning costs.  No good reason has been given for departing from the Court’s standard practice in relation to costs on an application for leave which has been dismissed.  In accordance with that practice, the applicant must pay the respondent costs of $2500 together with reasonable disbursements.
