[2012] NZSC 1
•1 February 2012
IN THE SUPREME COURT OF NEW ZEALAND
SC 114/2011 [2012] NZSC 1
JAMES JOSEPH KAPA
v
THE QUEEN
Court: Blanchard, Tipping and McGrath JJ
Counsel: Appellant in Person
Judgment: 7 February 2012
JUDGMENT OF THE COURT
ALeave to appeal is granted in respect of the sentence of reparation only.
BThe approved ground is whether the sentence of reparation complied with the requirements of s 32 of the Sentencing Act 2002.
REASONS
Leave is not granted for the proposed appeal against the sentence of imprisonment because no arguable question of principle is raised and the effective sentence and the minimum non-parole period were not manifestly excessive. Indeed they were fully justified.
