REASONS OF THE COURT

(Given by Miller J)

  1. Mr Hwang has applied to recall the Court’s judgment of 15 June 2023 declining him name suppression.[1]

    [1]H (CA34/2023) v R [2023] NZCA 240.

  2. Through administrative error Mr Hwang was given to understand the application for recall would be decided on the papers by a different panel in the week of 6 November.  The Court’s direction was rather that the matter would be decided by the original panel on the papers once Mr Hwang had filed submissions.  He has now done so.

  3. Mr Hwang’s submissions say that in his opinion the Court’s judgment was wrong.

  4. This is not an available ground for recall.

  5. The application is declined.
