JUDGMENT OF THE COURT

By consent, the appellant is ordered to pay costs to the respondent for a standard appeal on a band A basis in respect of each appeal, plus usual disbursements.

REASONS OF THE COURT

(Given by Arnold J)

[1]       The appellant has abandoned his appeals in CA296/06 and CA247/09.  The parties have agreed that the appellant should pay costs to the respondent for a standard appeal on a band A basis in respect of each appeal, plus usual disbursements.  We order accordingly.

[2]       We record that the parties have agreed that the total amount to be paid on this basis is $10,471.59, comprising $10,080.00 by way of costs and $391.59 by way of disbursements.
