Case

[2013] NZSC 73

23 July 2013

IN THE SUPREME COURT OF NEW ZEALAND
SC 29/2013
[2013] NZSC 73
BETWEEN

GRACE RIANA BOAGEY
Applicant

AND

THE QUEEN
Respondent

Court:

Elias CJ, William Young and Glazebrook JJ

Counsel:

Applicant in person
M J Lillico for Respondent

Judgment:

23 July 2013

JUDGMENT OF THE COURT

The application for recall is dismissed.

____________________________________________________________________

REASONS

  1. The applicant applies for the recall of our judgment of 2 July 2013 dismissing her application for leave to appeal.  As was the case with her original application for leave to appeal, the basis of the current application is not entirely clear.  The reality, however, is that there are outstanding charges against her which must be dealt with and there is no good reason why that should not be in the District Court at Manukau.  All the issues she has in relation to the charges which she faces are most appropriately dealt with in that Court.
