G V POLICE HC AK CRI 2008-404-51  2 April 2009

[1]      Mr G   has filed an appeal against his conviction entered in the District Court at North Shore on 19 February 2007 on charges of possession of controlled drugs.

[2]      Mr Jonathan Wiles has been instructed at short notice.   He has carefully examined the record and the decision of Judge Cadenhead under appeal.  The only possible area of challenge to the decision which Mr Wiles could identify was to the legality of the police search.  However, on careful reflection, Mr Wiles accepts that the Judge’s conclusion is unassailable.

[3]      I agree with Mr Wiles and respectfully compliment the Judge on a carefully reasoned decision.  I am not satisfied that he erred in any respect.  Accordingly the

appeal is dismissed.
