[1] The respondent was successful in opposing an appeal from a decision of the Family Court. The respondent now seeks scale costs in the sum of $10,755.00 pursuant to the High Court Rules.
[2] The appellant was legally represented at the substantive appeal but now represents herself in relation to the costs matter. She has filed a memorandum which essentially seeks to revisit the arguments made on the substantive appeal and to lay responsibility for the need for the appeal on the respondent. I reject those arguments.
[3] This was a simple case where there was little prospect of success on appeal. The general rule is that costs follow the event. There is nothing to distinguish this case from the general rule.
[4] I am satisfied the respondent is entitled to the costs he seeks. Accordingly, I award costs in the sum of $10,755.00 to the respondent.
