[1]      On 9 November 2005, in the District Court at Rotorua, Judge James Weir remanded Mr J  E   in custody for sentence in that Court on 7 December

2005.   Mr E   had pleaded guilty to three dishonesty charges.   The Judge directed preparation of a probation report.

[2]      Mr E   has  appealed  against  Judge  Weir’s  decision.    This  morning Mr Barclay has advanced the only possible argument available to him.   But, with respect, the appeal is hopeless and it is doomed to failure.  Judge Weir exercised his discretion to remand Mr E   in custody.   I am satisfied that he was plainly

correct.  Accordingly, the appeal is dismissed.
