[1]      This is an application for judgment against the third defendant by way of formal proof.

[2]      Having heard submissions of counsel for the plaintiffs and having read the affidavits in support of the application, I am satisfied that the application should be granted on the first and second causes of action in the statement of claim dated

9 March 2013.  The orders include interest, costs and disbursements as claimed in the statement of claim.   I make no order in respect of the third, fourth and fifth causes of action in the statement of claim.  Judgment may be entered in terms of the draft judgment attached to the application.
