JUDGMENT OF THE COURT

[1]       The three appellants appeal against sentences imposed by the District Court on charges brought under the Resource Management Act 1991.  Mr Conway was sentenced to three months imprisonment.  The two companies were ordered to pay substantial fines.

[2]       Having heard from counsel we have reached a clear view as to the outcome of the appeal.  As Mr Conway surrendered to bail this morning it is preferable that we express our conclusions immediately. 

[3]       All three appeals against sentence are dismissed.  Reasons for our judgment will be given later.
