JUDGMENT OF NATION J


[1]                 Having read the memorandum of counsel for the applicant, respondents and first interested party, I am satisfied the orders sought as reflecting a settlement between the parties are consistent with the purposes of the Act and are in the overall interests of the parties.

[2]                 I am satisfied the second interested party and third interested party have in fact no interest in the proceedings or property affected by the proposed order.

[3]                 I accordingly make orders as set out in the draft orders filed with counsel’s memorandum.
